1. The agreement
These terms are between you (the merchant operating the Shopify store on which Hybrid is installed) and Benjámin Márk, a sole trader of Hungary, 7562 Segesd, Dózsa tér 5, operating as Hybrid.
Installing the app constitutes acceptance. If you are accepting on behalf of a company, you confirm you have authority to bind it. If you do not agree, uninstall the app.
Your use of Shopify itself is governed separately by Shopify's own terms, which we neither control nor override.
2. What Hybrid does
Hybrid is a Shopify application providing a cash-on-delivery and checkout form for storefronts, together with the related features described on our site — including order pre-screening, quantity bundles and upsells, card-payment incentives, pickup-point selection, delivery emails and in-app analytics.
We may add, change or remove features. Where a change materially reduces functionality you rely on, we will give reasonable notice.
3. Eligibility
You must operate a legitimate Shopify store, be legally capable of entering a contract, and comply with the laws applying to your business — including consumer protection, distance selling, tax and cash-handling rules in every country you sell to.
4. Plans and billing
Hybrid is billed through Shopify's billing system. Charges appear on your Shopify invoice; we never handle your card details.
Plans are tiered by monthly order volume processed through the app:

Prices are in USD and exclude any tax Shopify applies. Current pricing on the pricing section of our site prevails over this table if the two differ.
If your order volume exceeds your plan's tier, we may ask you to upgrade. We will notify you before any change to your charge takes effect. We may change prices with at least 30 days' notice; continuing to use the app after that constitutes acceptance.
5. Trial and cancellation
Where a free trial is offered, it begins on install and converts to a paid subscription at the end of the trial period unless you uninstall first.
You can cancel at any time by uninstalling the app from your Shopify admin. Cancellation takes effect at the end of your current billing period. Because billing runs through Shopify, refunds are governed by Shopify's refund handling; we will support a reasonable refund request made through Shopify where the circumstances justify it.
6. Acceptable use
You must not:
- Use Hybrid to sell goods or services that are illegal in the jurisdiction of sale.
- Use the checkout form to collect data you have no lawful basis to collect.
- Misrepresent delivery terms, pricing or COD charges to shoppers.
- Reverse engineer, decompile or attempt to extract the source of the app.
- Resell, sublicense or white-label the app without our written agreement.
- Interfere with the app's operation, probe its infrastructure, or circumvent usage limits.
- Use the fraud-prevention features to discriminate on any protected characteristic.
We may suspend or terminate access for a material breach of this section, immediately where the breach is serious.
7. Your obligations
You are responsible for:
- The accuracy of product, pricing, shipping and COD-fee information shown in the form.
- Fulfilling orders the app creates in your store, and handling returns and refunds.
- Your own privacy notice and lawful basis for collecting shopper data — see our GDPR page.
- Credentials you enter into the app (SMTP, carrier accounts) and any activity under them.
- Configuring fraud thresholds appropriately for your business.
8. Data protection
For shopper data collected through the form, you are the data controller and we are your processor. We process it only on your instructions and as described in our Privacy Policy, which forms part of these terms. A Data Processing Agreement is available on request.
9. Third-party services
Some features depend on third parties — Shopify, parcel carriers such as FOXPOST, and your own email provider. We are not responsible for their availability, accuracy, pricing or acts. Your use of them may be subject to their own terms.
10. Availability
We aim to keep Hybrid available continuously, but we do not guarantee uninterrupted or error-free operation. The app may be unavailable during maintenance, during a Shopify outage, or for reasons outside our control.
Hybrid is provided "as is", without warranties of any kind beyond those that cannot be excluded by law. We do not warrant that fraud screening will identify every fraudulent order, or that a flagged order is in fact fraudulent — it is a signal for your judgement, not a guarantee.
11. Intellectual property
The app, its code, design, and the Hybrid name and branding remain ours. You get a non-exclusive, non-transferable, revocable licence to use the app on your store for as long as your subscription is active. Your store data, products and customer data remain yours.
If you send us feedback or feature suggestions, we may use them without obligation or compensation.
12. Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special or consequential loss, including lost profits, lost sales, lost data or business interruption.
- We are not liable for losses from undeliverable or fraudulent COD orders, whether or not the app flagged them.
- Our total aggregate liability is capped at the amount you paid us for the app in the 12 months before the claim arose.
Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected.
You agree to indemnify us against claims arising from your use of the app in breach of these terms or of applicable law, including claims by your shoppers about how their data was handled on your store.
13. Termination
You may terminate at any time by uninstalling. We may terminate or suspend for material breach, non-payment, or if required by law or by Shopify.
On termination your licence ends immediately, and your data is erased when Shopify sends the uninstall signal 48 hours later, as described in our Privacy Policy. Export anything you need before uninstalling. Sections 11, 12 and 14 survive termination.
14. Governing law
These terms are governed by the laws of Hungary, and the courts of Hungary have exclusive jurisdiction over any dispute — save that if you are a consumer, you keep the right to bring proceedings in your country of residence.
If any provision is found unenforceable, the rest remains in effect.
15. Changes to these terms
We may update these terms. The date at the top reflects the current version, and material changes will be notified in-app or by email. Continued use after a change constitutes acceptance.
